So, when it gets thrown to the Supremes, what will happen?

From USA Today: Chief Justice William Rehnquist is still unable to return to work. He is undergoing outpatient radiation and chemotherapy treatment for cancer of the thyroid.

“I’d think it would be very unlikely that he would be able to return to work,” said Joshua Ellenhorn, a surgeon at City of Hope National Medical Center near Los Angeles who specializes in cancers of the head, neck and thyroid. “If he returns, it probably won’t be for several weeks or months.”

So, we’re looking at a 4-4 split if he can’t hear the case.
